By registering to bid and/or submitting any bid, whether in person, in writing,
by telephone, or by using our secure, on-line bid-submission form, you acknowledge
and accept these Terms and Conditions of Sale.

MERCHANDISE OFFERED

• All items offered for auction will be sold AS IS, WHERE IS, and WITHOUT GUARANTEE.
• Bidders are responsible for examining all items and bidding according to their
  own expertise. If you have reservations about any item, please do not bid.
• All announcements made on the day of the auction supercede any other previously
  announced or published materials.
• Items may not be lotted/sold as shown in photographs in advertisements or on the website.
  Please call to confirm lots/groupings.

REGISTRATION and BIDDING

• Buyers must register for a bidding number at each auction, and must show it after each purchase.
• If you are a first-time bidder with Briggs Auction, Inc., you must register with us
  prior to submitting any bid.
• The Auction record kept by Auctioneer and Clerk is final.
• The highest bidder for each lot shall be the buyer, and if any dispute arises
  as to any bidding, or between two or more bidders, at the sole discretion of the
  auctioneer, the disputed lot shall be put up again at the last undisputed bid and resold.
• The successful bidder is responsible for all items after knock-down.

ABSENTEE and TELEPHONE BIDS

• Briggs Auction accepts Absentee Bids and Telephone (Live) Bids for our auctions. Absentee and Telephone bids may be submitted using the secure, bid form available on our website (Homepage and March 19th Auction page).
• All Absentee and Telephone bids are executed in a competitive manner.
• Absentee and Telephne bids have an equal chance of being successful as on-the-floor bids,
  yet do not take precedence over any bidding method
• If we receive two Absentee bids for the same item at the same amount,
  the first received will take precedence.
• Absentee and Telephone Bidding is a service we offer for the convenience of our customers.
  Although we make every effort to execute your bid, Briggs Auction is not liable for
  any errors or omissions.
• Telephone Bids are reserved on a first-come, first-served basis, and must be arranged
  no later than 4pm on Friday, March 19^th. We urge you to confirm telephone availability
  prior to submitting a telephone bid.
• We make every effort to notify successful Absentee bidders on the day following the auction.
  However, you may also check for yourself if your bid was successful by calling the SHOWROOM at 610-485-0412 between 11:00am- 2:00pm on Saturday, March 20^th.

PAYMENT

• All items must be paid for and removed within ONE WEEK of the auction, unless you make
  prior arrangements with us.
• For successful Absentee and Telephone Bids, full payment via Cash, Check, Credit Card, or
  Wire Transfer is required within one (1) week following the auction.
• A $20 fee will be assessed on all returned checks.

BUYER’S PREMIUM and SALES TAX

• The Buyer’s Premium of 15% will be added to each sale.
• Buyers are required to pay PA State Sales Tax (6%) on each sale, including the buyer's premium, unless exempted by law.
  If exempt, you must present us with a valid tax exemption number prior to the auction.

REMOVAL OF ITEMS/SHIPPING

• No item may be removed until full payment has been made.
• If an item must be left for pick-up at a later date, you may pick up the item on
  Saturday, March 20^th from 9:00am-2:30pm. If you cannot remove your item at that time,
  you must notify us as to when you will be able to remove the item.
  
• If you plan to pick an item up during the week, please call the Showroom
  at 610-485-0412 prior to arriving, to confirm that day's schedule.
• All shipping, packing, and handling costs are the responsibility of the buyer.
