AUCTION TERMS AND CONDITIONS

By registering to bid and/or submitting any bid, whether in person, in writing, or by telephone, you acknowledge and accept these Terms and Conditions of Sale.
We thank you for your interest and participation.
MERCHANDISE OFFERED
- All items offered for auction will be sold AS IS, WHERE IS, and WITHOUT GUARANTEE.
- Bidders are responsible for examining all items and bidding according to their
own expertise. If you have reservations about any item, please do not bid.
REGISTRATION and BIDDING
- If you are a first-time bidder with Briggs Auction, Inc., you must register with us
prior to submitting any bid, or your must submit your bid using our on-line Absentee/Telephone Bid Form.
- The Auction record kept by Auctioneer and Clerk is final.
- The highest bidder for each lot shall be the buyer, and if any dispute arises
as to any bidding, or between two or more bidders, at the sole discretion of the
auctioneer, the disputed lot shall be put up again at the last undisputed bid and resold.
- The successful bidder is responsible for all items after knock-down.
ABSENTEE and TELEPHONE BIDS
- Briggs Auction accepts Absentee Bids and Telephone Bids for our auctions. Absentee and Telephone bids may be submitted using the secure, on-line form on our Homepage.
- Bid Forms MUST be submitted prior to 4:00pm the day of the auction. If you submit a bid after 4:00pm you must call the showroom at 610.485.0412 to confirm receipt. We are not responsible for failure to execute unconfirmed bids submitted after 4:00pm.
- All Absentee and Telephone bids are executed in a competitive manner.
- Absentee and Telephne bids have an equal chance of being successful as on-the-floor bids,
yet do not take precedence over any bidding method
- If we receive two Absentee bids for the same item at the same amount,
the first received will take precedence.
- Absentee and Telephone Bidding is a service we offer for the convenience of our customers.
Although we make every effort to execute your bid, Briggs Auction is not liable for
any errors or omissions.
- We make every effort to notify successful Absentee bidders on the day following the auction.
However, it is always best to check for yourself if your bid was successful.
Please call the SHOWROOM at 610-485-0412 between 12:00 Noon- 2:30pm on Saturday.
PAYMENT
- All items must be paid for and removed within ONE WEEK of the auction, unless you make
prior arrangements with us.
- For successful Absentee Bids, full payment via Cash, Check, or Credit Card, is required
within one (1) week following the auction.
- A $20 fee will be assessed on all returned checks.
BUYER’S PREMIUM and SALES TAX
- The Buyer’s Premium will be added to each sale.
- Buyers are required to pay PA State Sales Tax (6%) on each sale unless exempted by law.
If exempt, you must present us with a valid tax exemption number prior to the auction.
REMOVAL OF ITEMS/SHIPPING
- No item may be removed until full payment has been made.
- If an item must be left for pick-up at a later date, you may pick up the item on
Saturday from 9:00am - 2:30pm. If you cannot remove your item at that time,
you must notify us as to when you will be able to remove the item.
- If you plan to pick an item up during the week, please call ahead to the showroom to learn that day's pick-up hours. Please Note: there may not be anyone available during the week to assist with loading large/heavy items.
